1. 研究目的与意义
Coincident with the concerns about the policy of the rule of law has been an increasing appreciation of the significant importance of laws. Nowadays law is playing an increasingly important role in our society.
First of all, legal English as a branch of English has its special features, which means that the study of legal English is not only a study about English itself and can provide English with new factors from the aspect of laws. The stylistic and syntactic studies o f languages have always been the main measures of English studies. As a universal language, English deserves to be studied from all aspects, especially from the stylistic and syntactic aspects. Secondly, under the policy of reform and opening-up, people who know laws well are in great need. There is no denying that laws are indispensable to a harmonious society. Language is a toll of communication and if we can associate it with other skills, we can turn ourselves into inter-disciplinary talent, which is consistent with the trends of the times. While, legal English as a language used in the profession of law is the dress of the legal thought and the embodiment of the legal spirit. Specialized terms and style make it difficult to understand let alone use it to guard ours rights or to maintain the justice of the society. Anglo-American law system is playing an important role in the history of the developments of laws. Communications and cooperation with foreign countries are one of those requirements to promote our own developments. As a result, the necessity of studying legal English thoroughly as follows: firstly, confronting trade disputes with other countries, we can use related laws to protect our own rights; secondly, it would be easier for us to go into internal markets without getting into traps; thirdly, necessary knowledge of legal English is vital to the implementation of the policy of reform of opening-up. With the help of knowledge of legal English, it will be easier for us to promote our financial and social developments by leading into foreign capital or going into foreign markets.
2. 研究内容和预期目标
This paper mainly aims at analyzing the syntactic and stylistic features of Legal English. All the statute laws are expressed by specialized terms and words, which forms their unique stylistic and syntactic features. By exploring the syntactic and stylistic features of legal English, we can understand the literal meanings of legal contexts and as a result, we can have a general knowledge of the rules of legal English.
If we can have enough knowledge of legal English itself and its rule, then we can generalize the legislative spirits from legal texts. While, the first step is to analyze the syntactic and stylistic features of legal English, so that we can understand the law texts thoroughly. The study of the syntactic and stylistic features of legal English is not only a measure of English study, but also a guarantee of the policy of reform and opening-up. In one word, this study is of great value and which is very practical.
3. 国内外研究现状
Few professions are as concerned with language as is the law. (Tiersma, 1993:69,113-137). In fact, except some books such as Investigating English Style written by David Crystal and Derek Davy and Instruction to English Stylistics edited by Wang Zuoliang and Ding Wangdao are related with the syntactic and stylistic features of Legal English, books that are related with legal English are very hard to be found. In our country, #8220;法律英语#8221; is translated into legal English, while in countries that use English as mother language it is called #8220;the language of law#8221;. In those countries, legal English is regarded as one kind of English for specific purpose (which is called ESP in short). ESP is divided into English for science and technology(EST in short), business English and English for social sciences (ESS). Legal English is business professional English belonging to business English. Based on the studies of Mellinkoff and David, some experts in foreign countries have deepened their studies of the syntactic and stylistic features of Legal English and divided them into four stages: register analysis, target situation analysis, discourse analysis and skill and strategies analysis. Some experts in our country hold the idea that the fifth stages of ESP should be the stage of learning-centered approach.
Forensic linguistics became an independent subject in 1993.( 吴伟平, 1994:44). In the early time, documents edited by exports in our country introduced some characters of legal English, such as legal English do not have independent speech sounds, syntactic structure, and lexical system. While legal English has its specialized terms and unique stylistic features. Then some experts refine legal English, which involve so many aspects, such as place of occurrence, the people who use them, the way people use them, the scope of usage, function and so on. After entering the new century, more experts define legal English from its function and rules of using. These definitions are mainly according to documents from foreign countries that use English as mother language. However, no matter how we definite legal English, the common point that there is a higher requirement for legal English teaching in the aspects of its language features and strong partialness.4. 计划与进度安排
Before writing my paper, I will read some books that mention the syntactic and stylistic features of Legal English. At the same time, I will write down some key points, in order to analyze the same points and different points. In this way, I can gain a generally idea of the features of legal English. Based on the knowledge, I can form my own idea.
Secondly, I believe it is necessary for me to read some original manuscripts of legal text to see how rules of laws are expressed. It is vital to the understanding of syntactic and stylistic features. It can also help me to gain some knowledge about laws. In order to write my paper smoothly, knowing some primary rules of laws and foster my legal consciousness are absolutely necessary.
Thirdly, helps from professors and others who know English or laws well are also indispensable. I will ask my teacher how to organize my paper and which are necessary to be written and which are the key points that need to be elaborated. Moreover, I will turn to someone who knows laws well for help, because there must be something I do not understand if I read some original manuscripts of legal text.
Last but not least, it is also indispensable that I can surfer the internet to find any information that is helpful to me. There must be some meaningful points of the syntactic and stylistic features that I ignored. By communicating with others on the internet, I can also ask someone who major in laws or knows laws well some professional questions that can help me to finish my paper.
